Never-Bound Site Terms
Version 2026-09-26.1
Never-Bound™ is an unregistered trademark of HappyRock L.L.C. HappyRock L.L.C. is the contracting party. Never-Bound is not a company.
These Site Terms govern use of the venue. Listing and the limited agency appointment are also governed by the Agency & Marketplace Terms. A privacy notice is posted at /privacy.
1. Eligibility. You must be 18 or older to create an account, list work, subscribe to the house, spend coins. This is a self-attestation. HappyRock L.L.C. does not verify age with documents. Browsing the stall may be age-gated. If you are not 18, do not create an account, list, subscribe, spend coins.
2. Account, security, and deletion. You are responsible for the papers you use to enter (email, password, and any session). Keep them to yourself. Tell us at legal@neverbound.app if you think someone else used your account. You may ask us to delete your account. Deletion ends access. It does not move copyright, does not unwind a house subscription already processed, and does not erase records we must keep for law, payment disputes, or safety. Listings you posted may be hidden or withdrawn. Personal backups you already made remain your copies only.
3. License to operate the venue. You keep copyright and moral rights in what you list or write. You grant HappyRock L.L.C. a limited, revocable, non-exclusive, non-transferable license to host and display the listing and authorized preview, and to run stated safety and integrity scans. No other rights. The license ends on withdrawal. No sublicense except as needed to operate hosting and payments. No training rights. No house-created derivative of the manuscript. That license is not a publishing agreement and not an assignment. HappyRock L.L.C. does not become the publisher or the author. Featured and archive are merchandising, not editorial acceptance.
4. Prohibited content. You will not post, list, upload, or request: sexual content involving minors, fictional or not; doxxing; operational instructions for weapons or violent crime; someone else’s published book pasted in; or other infringing material. HappyRock L.L.C. may hide, hold, delete, or refuse that material and may suspend or end the account.
5. House subscription, coins, and patronage. A house subscription is ten dollars a month for time in the room and house coins. Each paid month grants 250 coins and thirty days as a guest. It renews until canceled. Cancel anytime; the month already paid still stands. Coins are closed-loop scrip for use on this stall. They have no cash value, are non-transferable, cannot be cashed out by spenders, are not securities, and are not a purchase of copyright or of a file. Coin left in an author’s jar is patronage: a voluntary gratuity to the pen name, not the purchase price of the literary work, and it grants no copyright or license. A house subscription is venue access, not a listing jar. Subscribing and coin gifts grant no rights to the tale. A receipt states: this is not a purchase of the literary work and grants no copyright or license beyond the viewing rules already accepted.
6. Payments and refunds. The only card payment is the house subscription: a Stripe subscription on the open web and a Google Play subscription inside the Play Store listing. HappyRock L.L.C. does not store full card numbers. House subscriptions and coins are non-refundable except where law requires. Coin in an author’s jar is a gift, not a purchase of the work.
7. Disclaimer of warranties. THE VENUE IS PROVIDED “AS IS” AND “AS AVAILABLE.” HAPPYROCK L.L.C. DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE FULL EXTENT PERMITTED BY LAW. Listings are tales displayed by their listers. HappyRock L.L.C. does not warrant that a listing is accurate, complete, non-infringing, or that the stall will be uninterrupted or error-free.
8. Limitation of liability. TO THE FULL EXTENT PERMITTED BY LAW, HAPPYROCK L.L.C. IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL. HAPPYROCK L.L.C.’S TOTAL LIABILITY FOR CLAIMS ARISING OUT OF THESE SITE TERMS OR THE VENUE IS LIMITED TO THE GREATER OF (A) THE FEES YOU PAID TO HAPPYROCK L.L.C. IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (US$50). Some places do not allow these limits; there, they apply only as far as the law allows.
9. Indemnity. You will defend, indemnify, and hold harmless HappyRock L.L.C. and its officers, members, and agents from claims, damages, losses, and reasonable legal fees arising out of your content, your use of the venue, your listings, your house subscription or coin, or your breach of these Site Terms, except to the extent caused by HappyRock L.L.C.’s willful misconduct.
10. Copyright notices (DMCA). If you believe material on the stall infringes your copyright, send a notice to the designated agent:
Designated agent name: [TODO: designated DMCA agent name]
Physical address: [TODO: designated DMCA agent physical address]
Telephone: [TODO: designated DMCA agent telephone]
Email: legal@neverbound.app
The notice should include: (a) your physical or electronic signature; (b) identification of the copyrighted work; (c) identification of the material and where it sits on the stall, with a URL if you have one; (d) your name, postal address, telephone, and email; (e) a statement that you have a good-faith belief that the use is not authorized by the owner, its agent, or the law; and (f) a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorized to act for the owner.
If your material was removed and you believe it was a mistake, you may send a counter-notice to the same agent with: your signature; identification of the removed material and where it appeared; a statement under penalty of perjury that you have a good-faith belief it was removed by mistake; your name, address, and telephone; and consent to the jurisdiction of the federal district court for the district where your address is (or, if outside the United States, any district in which HappyRock L.L.C. may be found), and that you will accept service from the original complainant. We may restore the material unless the complainant files a court action as the statute requires.
Counsel will fill the TODO fields before relying on this designated-agent block.
11. Moderation. HappyRock L.L.C. may hide, hold, refuse, or remove listings, accounts, and other material, and may suspend or end access, to enforce these Site Terms, the Agency & Marketplace Terms, safety rules, or the law. It is not obligated to monitor the stall or to take any particular action. Moderation, merchandising, scans, and inventory decisions do not make HappyRock L.L.C. the publisher of a work. “Featured” and “archive” are venue merchandising, not editorial acceptance. Withdrawal ends the display license. HappyRock deletes the full text and keeps hashes, timestamp proofs, and audit metadata. A sealed copy remains only if the writer asked to keep one. Scans run only for safety, prohibited-content rules, generative-prose detection, and inventory integrity. HappyRock does not train models on stall text.
12. Governing law and venue. These Site Terms are governed by the laws of the State of [TODO: governing-law state], United States, without regard to conflict-of-law rules. Exclusive venue for disputes is the state or federal courts located in [TODO: venue city and state], unless applicable law requires otherwise. Counsel will fill these TODO fields before relying on this clause.
13. Changes. HappyRock L.L.C. may change these Site Terms. The version and date sit at the top of this document. We will post the new text on /terms. Continued use of the venue after notice of a change is acceptance of the new terms. A version already accepted for a stored clickwrap is not rewritten by a later posting unless you accept the new version on the site.
14. Contact. Legal: legal@neverbound.app. Privacy: privacy@neverbound.app. Do not use noreply@neverbound.app for legal or privacy notices; that address is for operational mail only.

Never-Bound Agency & Marketplace Terms
Version 2026-09-26.1
Never-Bound™ is an unregistered trademark of HappyRock L.L.C. HappyRock L.L.C. operates the stall. HappyRock L.L.C. is the limited agent. Never-Bound is not a company and is not the contracting party.
1. Limited agency. By listing a manuscript or character on Never-Bound, you appoint HappyRock L.L.C. as your limited agent solely to: (a) display the listing on the stall; (b) run safety and generative-prose scans; (c) send operational notices; and (d) hide, hold, or withdraw a listing when safety or inventory rules require it. HappyRock L.L.C. records house subscriptions and coin gifts. It does not take copyright.
2. Not a publishing agreement. This appointment is limited and non-exclusive. It is not an exclusive publishing agreement, a commission, or an acceptance for publication. HappyRock L.L.C. does not take copyright, moral rights, or any obligation to publish, market, typeset, distribute, or sell the work to the public as a publisher.
3. Listing is display. A listing shows a tale that never was: complete, fragmentary, abandoned, or hypothetical. It may have an author’s jar for gifts. No listing offers ownership or paid rights to the work.
4. What you represent. You represent that you have the right to list the work (you wrote it or are authorized), that it is a tale that never was — complete, fragmentary, abandoned, or hypothetical — and that it is not someone else’s book pasted in. You will not list sexual content involving minors, doxxing, or operational instructions for violent crime.
5. Age. You must be 18 or older to list. That checkbox is a self-attestation. HappyRock L.L.C. does not verify identity or age with documents.
6. House subscription and scrip. A visitor may subscribe to the house for ten dollars a month. The subscription renews until canceled. Each paid month grants time-limited premium access and 250 house coins (scrip). Cancel anytime; access already granted for a paid month still stands. Coins are not stock, not a claim on a copyright, and not a purchase of a file. They are non-refundable except where law requires, cannot be cashed out by spenders, and buy no extra copyright rights. A house subscription is not a listing jar. Public copy: “You are subscribing to the house. You are not buying this tale, and you are not filling an author's jar.”
7. Card payments. The only card payment offered is the house subscription. On the open web it is a Stripe subscription. Inside the Play Store listing it is a Google Play subscription.
8. Coin gifts. Coin in an author’s jar is a gift, not a purchase of the work. It grants no copyright or publishing rights.
9. Records. Copyright stays with the lister. A listing is not a publication.
10. Removal. HappyRock L.L.C. may hide, hold, or withdraw a listing to enforce safety and inventory rules (including listing a character apart from its story). That is agency inventory, not a recall of a published edition.
11. Author gifts. A coin spent on a listing or pen-name jar is a voluntary gratuity processed by the house as agent for that pen name. It is a gift supporting the author’s participation on the stall. It is not the purchase price of the literary work and grants no extra copyright rights. The writer keeps the work and its rights.
12. Creator payouts. Authors who accept the creator agreement, attest they are 18 or older, warrant they own or control the work, complete tax identity (W-9 / W-8BEN) and payout KYC through Stripe Connect, and meet the published minimum may receive patronage. The house does not take a venue fee from patronage. Payment-processor fees come out at payout. The house may freeze, reverse, or hold funds for fraud, chargebacks, or policy breaks. Authors who have not finished KYC can receive jar activity but cannot withdraw. Year-end forms issue when legally required. No promise of earnings. No secondary market for coins.
13. License to display. Writer grants HappyRock L.L.C. a limited, revocable, non-exclusive, non-transferable license to host and display the listing and authorized preview, and to run stated safety and integrity scans. No other rights. The license ends on withdrawal. No sublicense except as needed to operate hosting and payments. No training rights. No house-created derivative of the manuscript. Copyright stays with the lister. Visitors receive a personal, revocable, read-only look while the rules allow. HappyRock L.L.C. is venue and limited agent, not publisher or employer.
